Where your funds sit and what protects them if the platform behind them fails.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Where Does Your Money Actually Sit on a CASP-Authorised Platform?<\/h2>\n\n\n<div class=\"text-bg-color-border\" id=\"block_3dcd77bb495b1943caa4df9aeaa99546\">\r    <div class=\"text-bg-color-border__content\">\r        <p>Your money sits in two separate places, both kept apart from the platform&#8217;s own funds. Your crypto is held in custody wallets recorded in your name. Your cash is deposited with a bank in a client account.<\/p>\n    <\/div>\r<\/div>\n\n\n<p class=\"wp-block-paragraph\">MiCA splits the two on purpose. Crypto and cash carry different risks, so they are safeguarded in different ways.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For crypto, the platform holds your assets in custody and records them against your name in a client register. For cash, the platform has to place client funds with a bank, usually by the end of the next business day. In both cases, your money stays separate from the platform&#8217;s own balance sheet.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What Does &#8220;Segregated&#8221; Really Mean Here?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Segregated means your assets are kept apart from the platform&#8217;s assets, both in practice and in law. On the blockchain, client crypto sits in different addresses from the platform&#8217;s own crypto. In law, client assets are ring-fenced from the platform&#8217;s estate.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There are two layers to this. The first is operational. A CASP keeps client crypto in wallet addresses that are separate from its own holdings, and keeps client cash in separate bank accounts.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The second layer is legal, and it matters more. Under MiCA, client crypto held in custody is legally separated from the platform&#8217;s estate. That means the platform&#8217;s creditors have no recourse to it. Your assets are held on your behalf. The platform does not own them.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What Happens to Your Funds if the Platform Fails?<\/h2>\n\n\n<div class=\"text-bg-color\" id=\"block_6754233d0883037316b2144c2b42ced8\">\r    <div class=\"text-bg-color__content\">\r                <p>Because client assets are segregated in law, they are not part of the platform&#8217;s estate in an insolvency. A licensed platform also has to keep an individual register of what it holds for you and a documented process to return your assets, even if it becomes insolvent.<\/p>\n    <\/div>\r<\/div>\n\n\n<p class=\"wp-block-paragraph\">This is the practical payoff of segregation. If a CASP fails, the assets it holds for clients are meant to be identifiable and returnable, rather than swept into the general pool for creditors.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Two things support that. The platform keeps a register of positions in each client&#8217;s name, so who owns what is on record. It also has to hold a defined amount of its own capital as a buffer. For custody and exchange services, that own-funds floor is set by MiCA.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Nothing removes risk entirely. But the gap between a regulated and an unregulated platform is widest exactly here, at the moment something goes wrong.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Who Is Responsible if Your Assets Are Lost?<\/h2>\n\n\n<div class=\"text-bg-color\" id=\"block_84e87207080a374334aac171bb8e1cff\">\r    <div class=\"text-bg-color__content\">\r                <p>The platform is. Under MiCA, a CASP that holds your crypto in custody is liable for its loss, for example from a security incident it is responsible for. That liability is capped at the market value of the assets at the time of the loss.<\/p>\n    <\/div>\r<\/div>\n\n\n<p class=\"wp-block-paragraph\">This is a real change from the older model, where a hack often meant the loss simply fell on users. A licensed custodian now carries that risk itself.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There are limits. The liability covers incidents attributable to the platform. Events outside its reasonable control, such as certain underlying blockchain failures, sit outside the rule. Even so, the default now puts the responsibility on the platform rather than the user.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">How Does Paybis Hold Funds?<\/h2>\n\n\n<div class=\"text-bg-color\" id=\"block_c42b47612794c866410f2c5f1400082d\">\r    <div class=\"text-bg-color__content\">\r                <p>Paybis operates as a licensed platform with these duties built in. It holds full MiCA CASP authorisation from the Bank of Latvia, granted in May 2026. It also holds a PSD2 Payment Institution licence from the same regulator. Your crypto sits in segregated custody in your name. Your cash sits at a bank in a client account.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The point of the rules is simple.
